About the Department
The regulation and supervision of professional trustees and other fiduciaries falls within the remit of the MFSA and in fact the MFSA has a specific function designated with the responsibility for both the authorisation as well as the supervision of trustees and other fiduciaries. The function's main objective is to ensure that licensed trustees and fiduciaries have the appropriate structures and systems in place to service clients adequately whilst at the same time preserving their reputation as well as Malta's reputation, taking into account its international commitments.
About the Role
Within this role you will be joining the Trustees Supervision Function, focussing in particular on the authorisation and approval processes, as well as being involved in the ongoing review of conduct of the respective licence holders.
Your work will include any of the following tasks aimed at verifying that authorised trustees and other fiduciaries are meeting the requirements of the Trusts and Trustees Act and the relevant rules and regulations:
• Assessing and processing applications received for authorisation as trustee, mandataries and, or administrators of private interest foundations.
• Analysing and processing Personal Questionnaires submitted by persons proposed to hold key roles in the operations of applicants or authorised persons, and assessing the applicant’s fitness and properness for the role.
• Assessing and processing requests for changes in shareholding and, or other related requests by existing licence holders.
• Engaging with other relevant Functions within the Authority for a complete assessment and making recommendations to Senior Management.
• Providing ongoing support to the Supervision team within the Function, as necessary, including reviews of offsite regulatory submissions and returns or supporting/ participating/taking the lead in onsite inspections and other supervisory engagements.
• Addressing queries from authorised persons relating to prospective applicants or matters relating to supervision;
• Monitoring compliance with beneficial ownership reporting requirements applicable to trustees.
• Mentoring and managing more junior team members to fulfil any of the duties described above as necessary, and ensuring that the duties assigned to the team are effectively carried out.
• Attending meetings internally as well as externally.
• Undertaking any other tasks as delegated by senior management in line with the exigencies of the Function.
About You
We are looking for candidates with solid academic background in Law, Banking & Finance or in another related background.
The role calls for an academic qualification in a relevant field of study at National Qualification Framework Level 6 or better, duly certified by the Malta Qualifications Recognition Information Centre (MQRIC) or a widely recognised professional qualification at a comparable level. You will also possess a minimum of five (5) years working in financial services.
If you do not have the necessary academic or professional qualifications but you have at least ten (10) years of relevant experience, we would still be interested in speaking with you.
