Overview

About the department

The Capital Markets Supervision Function oversees financial markets to ensure investor protection and orderly markets. This is achieved through various policy and supervisory work done at the stages of primary market, secondary market and post-trading.

The Capital Markets Supervision Function’s responsibilities include the processing of applications for admissibility to listing on regulated markets in Malta, the approvals of prospectuses in terms of the Prospectus Regulation, the supervision of the continuing obligations of companies having securities listed on regulated markets in Malta, the supervision of markets to identify any market abuse, the authorisation and supervision of trading venues, central securities depositories and crowdfunding platforms, the supervision of financial and non-financial entities falling under the scope of EMIR and SFTR, the data quality assurance of submissions made under EMIR, SFTR, MiFIR and CSDR, the supervision of administrators, contributors and users of benchmarks in terms of the Benchmarks Regulation and the oversight of activities in terms of the Securitisation Act and the Securitisation Regulation.

The Capital Markets Supervision is also actively involved in various other initiatives such as the DLT MTF Pilot Regime.

About the Role

You will be expected to assist with providing efficient and professional advice on policy, regulatory, and legal matters and contribute to the various duties that are undertaken by Capital Markets Supervision, including the following tasks as necessary:

  • Developing and drafting of legislative amendments, including preparing the relevant documentation for the publication of such amendments, which may need to be made to national legislation to address areas of concern and, or to align such legislation with guidelines, standards, recommendations and opinions that may be issued by regulatory bodies such as ESMA amongst others;
  • Assisting in the transposition of any relevant EU Directives and the implementation of EU Regulations and regularly liaising with the Legal and International Relations Function within MFSA;
  • Assisting with providing legal advice to the Capital Martkets Function, other functions of the MFSA and other authorities as necessary;
  • Actively participating in and attending local and overseas training, meetings and working groups 
  • Drafting of and participating in the development of the internal procedures of the function;
  • Participating in the preparation of policy stances on regulatory issues and providing legal advice with a view to the consistent and effective application of the local applicable legislation as well as European legislation;
  • Attending to stakeholders' questions related to the supervision and regulation of licence holders supervised by the Capital Markets Function;
  • Handling day-to-day regulatory issues emerging from the ongoing supervision process;
  • Any other duties that may arise depending on the exigencies of Capital Markets Supervision Function and the Authority.

About You

We are looking for candidates with a solid academic background in financial services/law or in any other related background considered relevant to this post. A sound knowledge of financial services legislation and familiarity with the financial services regulatory framework would be considered as an asset. 

The role calls for an academic qualification in a relevant field of study at National Qualification Framework Level 6 or better, duly certified by the Malta Qualifications Recognition Information Centre (MQRIC) or a widely recognised professional qualification at a comparable level. 

Preference shall be given to candidates who demonstrate depth and range of experience in the area of financial services and who possess one or more of the following:  

A University of Malta Degree in Law (LL.D or Master of Advocacy level) or a comparable recognised legal qualification);  

Relevant professional experience within the financial services industry,

Education and Experience
  • University of Malta Degree in Law (LL.D or Master of Advocacy level) or a comparable recognised legal qualification at National Qualification Framework Level 6 or better duly certified by the Malta Qualifications Recognition Information Centre (MQRIC). A post graduate degree in a discipline relevant to the financial services sector would be considered an asset.
